The Federal Trade Commission wrote a letter of comment to the West Virginia legislature, stating the FTC opinion against Senate Bill 516, that would amount to a restriction of trade. This bill before the WV legislature would give authority to the Boards of Medicine and Osteopathy to issue "prescribing" privileges without the collaborative agreement for APRNs. This bill, if passed, would bring WV APRNs under the control of the Boards of Medicine and Osteopathy. The FTC calls this a restriction of trade with consequences for healthcare delivery in WV. The letter can be located as an attachment to this message.
